PDS ENGINEERING & CONSTRUCTION INC ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional industrial construction, warehouse development, and general contracting services. By authorizing a site evaluation, signing a commercial construction agreement, scheduling architectural planning, or using our digital client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our industrial building services.
We provide comprehensive general contracting and new construction services specifically focused on industrial buildings, commercial warehouses, and manufacturing facilities. This includes, but is not limited to: site excavation, structural steel erection, concrete foundation pouring, and industrial facility build-outs. The specific scope of our commercial contracting work, heavy machinery deployed, and materials used for your property will be defined exclusively by a separate, fully executed written construction contract.
All commercial construction estimates provided by our team are valid for 30 days. Final construction costs may vary if hidden subterranean conditions or undisclosed zoning restrictions are discovered during our site excavation (e.g., massive ledge rock, hazardous soil contamination, or high water tables common in Connecticut). Any major deviations from the original industrial blueprints require a formal, written change order approved by the Client.
Clients are strictly responsible for funding their commercial projects according to the payment schedule outlined in their specific contract or escrow agreement. Deposits are generally required before our procurement teams begin ordering bulk construction materials (e.g., structural steel, specialized HVAC units, or custom industrial roofing). In accordance with state law, we reserve the right to apply a statutory mechanic's lien under Connecticut law to the property for unpaid contracting fees, labor, or building materials.
The Client agrees to provide our construction crews, excavators, and subcontractors with safe, unobstructed access to the property during scheduled construction hours. The Client is strictly responsible for securing the site perimeter and ensuring that all non-essential personnel are cleared from the active industrial construction zone prior to our arrival for site development.
While we strive to adhere to estimated commercial construction timelines, all building dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe New England weather conditions (e.g., heavy rain, blizzards, or freezing temperatures creating unsafe conditions for concrete foundation pouring or steel erection).
During active industrial construction, Clients and their representatives must maintain a safe distance from our heavy machinery, open trenches, and active structural framing zones at all times. Unescorted visits to the active jobsite are strictly prohibited to comply with OSHA safety regulations and liability reasons. All construction equipment provided by the Company is to be operated exclusively by our trained staff.
You agree to accurately identify property lines and authorize excavation work only if you are the legal owner or authorized developer of the site. Crucially, the Client is responsible for disclosing the location of all private underground utilities and environmental hazards prior to any earthwork, including private industrial waste lines or private electrical conduits. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Connecticut Call Before You Dig (CBYD 811) for public utility locates as required by law prior to major excavation.
The Company maintains comprehensive commercial professional and general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any industrial building project is strictly limited to the direct cost of correcting our specific scope of work. We are explicitly not responsible for pre-existing environmental contamination, damage caused by natural settling, or any indirect, incidental, consequential, or punitive damages affecting your business operations.

Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state and federal courts located in Hartford County, Connecticut.
You agree to fully indemnify and hold harmless PDS ENGINEERING & CONSTRUCTION INC, its general contractors, crews, and staff from any claims, damages, or liabilities arising from your failure to secure necessary municipal zoning approvals, environmental clearances, or your failure to disclose private underground utilities. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
